  1. The person must be recognizable or identifiable in the publication.
  2. The image must be publicly distributed.
  3. There must be no consent from the person depicted.

Dreyfus assists clients in sending cease and desist letters to the publisher to cease the violation, avoiding litigation.

For images taken in public places, Dreyfus advises on seeking an injunction to stop the violation and remove the images, as well as seeking damages.

Direct Contact and CNIL Complaints

Dreyfus can guide direct contacts with the responsible party for stopping the violation. If this fails within two months, a complaint can be filed with the CNIL.
