Before registering a trademark, you need to be certain that no prior rights have been registered. Simply stated, your trademark must be available and you should be the first person to register it.
It is important to know that the notion of a prior rights-holder should be understood broadly.
Not only your mark should not resemble a prior trademark, but it also should not infringe on any kind of prior rights, such as copyright (including song titles, film titles, pictures), trade names, registered designations of origin, associations, domain names, corporate names, etc.
